Common Traffic Violations
Our traffic lawyers handle a range of traffic offenses for New York drivers. Some common traffic violations include:

The above offenses will result in a range of penalties including fines and jail time. For instance, basic speeding is punishable by $45-$100 in fines and/or up to 15 days in jail, while absolute speeding violations are punishable by $45-$600 in fines and/or up to 30 days in jail. Speeding in a school zone will result in enhanced penalties around $45-$1,200 in fines and 30 days in jail.
Speeding may be associated with reckless driving, which is punishable by $300 in fines and days to months in jail, depending on the number of prior offenses.
While drivers can be penalized for activity on the road, they may also face consequences for procedural mistakes in the vehicle, such as failing to wear a seat belt. The driver and each passenger in the front seat are required by law to wear a seat belt, and they may be fined up to $50 each if they fail to do so. Additionally, each passenger under 16 years old must wear a seat belt or use an appropriate child safety restraint system. It is the driver’s responsibility to make sure that each passenger obeys these laws, and they can be fined $25-$100 for each violation.

Driver Point System
In addition to fines and jail time, convicted drivers will also incur several points on their driving record that may lead to further penalties down the line. If a driver accumulates 11 points within 18 months, their license may be suspended. Some examples of traffic violations and their associated point penalties are:
- Speeding (1-10 mph over) – 3 points
- Speeding (11-20 mph over) – 4 points
- Speeding (21-30 mph over) – 6 points
- Speeding (31-40 mph over) – 8 points
- Speeding (over 40 mph) – 11 points
- Reckless driving – 5 points
- Texting while driving – 5 points
- Failing to abide by child safety restraint laws – 3 points
It is possible to reduce your points total by taking a DMV-approved Point and Insurance Reduction Program (PIRP) if you have 11 or more points on your record. Note that this will subtract 4 points from your total for the purposes of calculating a license suspension, but they will not be physically removed from your record.
